Creations by TYCP reserves the right to decline orders that are political, religious, controversial, lewd, disrespectful or do not fit the celebratory nature of our business. If we elect to decline an order, a full refund will be provided to the original form of payment.
PAYMENT TERMS
A retainer fee is payable at the time of booking in order to secure your reservation and confirm your date. The remaining balance is due two (2) weeks prior to the date of event. If the date of event is less than two (2) weeks from the booking date, payment in full (100%) is required. Once final payment has been made, there will be no refunds.
Payment information is transmitted over secure SSL encryption and is not stored on our website or payment systems, unless you opt in to save your payment information on file.
INSTALLATION AND PICKUP
Client is fully responsible for providing timely access to the event area for delivery, installation, and pickup. We cannot be held responsible for delays (or incomplete décor) if not allowed a reasonable amount of time to complete services as described in this agreement.
For our safety, the Client agrees to ensure someone at the delivery location is aware Creations by TYCP will be at the premises on the scheduled delivery date. We will request a point of contact and their contact information so they, too, will be advised of the installation and pickup dates and times.
DAMAGES & THEFT
Client is not allowed to move, remove, or attach anything to the balloon decor or equipment, including but not limited to, tape, adhesive, glue, clips, balloons, streamers, silly string, photos, and signage.
The Client, regardless if the balloon decor or equipment is delivered and installed at a location not owned or leased by you or not within your care, custody, or control, understands and agrees to pay charges equal to the full replacement value of each item if any components of the balloon decor or equipment are damaged or missing during your rental period, and you will be invoiced for the cost to replace the item(s), which may exceed the contracted cost.
SAFETY WARNING
For your safety and the safety of others, Client agrees to not play or allow anyone to play on or around any of the Creations by TYCP balloon decor or equipment as it may contain pointed corners and straight, sharp edges, and it will not support the weight of an adult, child, or animal.
Client further agrees to not allow anyone to inhale helium from the filling equipment or from balloons! Inhaling helium gas directly from high-pressure tank or inflated balloons can cause dizziness, drowsiness, loss of consciousness or other serious injury. Popping balloons may cause serious injury. Protective gear, including eye shields, should be worn. Client is responsible for supervising all use, and preventing all misuse or abuse of helium, balloons, equipment and materials related to the event.

HOLD HARMLESS AND LIABILITY CLAUSE
Client hereby agrees to hold harmless and without liability, Creations by TYCP and all its principals, owners, managers, employees, agents, volunteers or representatives from any of the following:
Helium inhalation or injury from lack of oxygen, slipping on broken balloons, latex allergies, children having access to balloons before, during or after events, children putting balloons in their mouths and choking, eye/facial/body injuries from popping balloons, heart attacks from popping balloons, hearing loss due to popping balloons, lesions, abrasions, suffocation, choking, loss of sight, loss of hearing, dizziness, drowsiness, loss of consciousness, broken body parts, death or any other personal or property damage caused or alleged to have been caused by popping balloons, or damage to swimming pool filtration systems caused by broken balloons.
Creations by TYCP and its principals, owners, managers, agents, employees, volunteers, and representatives are not responsible or liable for any injury or damage that may be caused to any person, real property or personal property, including but not limited to the residence/structure, lawn, lawn accessories/components, sprinkler system and its components, flooring, and/or walls, during installation, the duration of the rental period, and/or removal of the balloon decor or equipment.
OUTDOOR DECOR CLAUSE
Creations by TYCP uses only the highest quality products and make every possible effort to ensure that your décor will meet or exceed your expectations. However, due to the general nature of balloons, we cannot guarantee that your balloons will remain perfect and intact when used outdoors. Therefore, we highly recommend Client has a secondary plan to include an indoor location for the balloon decor or equipment to be installed.
If inclement weather conditions make it difficult or impossible to complete the installation as specified, we will do our best to be flexible with providing décor alternatives. Sunshine, wind and other atmospheric conditions dramatically affect balloon décor and we CANNOT guarantee the balloon decor will withstand inclement weather. It is clearly understood there will be no refunds or discounts allowed for loss, breakage or failure to install due to factors outside and beyond our control.
INCLEMENT WEATHER
Creations by TYCP reserves the right to decline delivery, installation, or removal of the our equipment and materials if there is inclement weather - including but not limited to - lightning, thunderstorms, snow, ice, very cold or warm temperatures, hurricanes, heavy rain, high winds, and any other act of God that would put our representatives or equipment and materials in harm's way.
If we are unable to reschedule the date to install balloon decor or equipment, we will provide a credit equal to 100% of the fee to be applied towards a future date up to one year.
CANCELLATION / REFUND POLICY
If Customer cancels or postpones the rentals and balloon décor for any reason, the deposit will not be refunded; however, a credit is issued which can be applied to any future event for up to one year. Any paid monies will not be credited if the cancellation or postponement occurs within three days of scheduled delivery date. A design change fee minimum of 10% of the new total will apply to all changes made within 24 hours of event date. Fees may vary depending on the extent of the change.
Creations by TYCP will not issue refunds or credits for the following:
• Customer, the Customer's representation or venue denies installation or requests earlier removal/pickup time.
• Errors that occur on order submission due to incorrect information entered by lessee.
• We are denied access to delivery location.
• Unrestrained animals that may pose a threat or endanger our safety.
• The safety and concern of any representative of Creations by TYCP is at risk.
• Any other circumstance beyond our control which prevents Creations by TYCP from installing upon our arrival.
